Tom Green County Commissioners Court

• Commissioners Court has held multiple public discussions regarding the proposed Beacon Data Centers project.
• A proposed moratorium for Precinct 4 was introduced by Commissioner Shawn Nanny.
• Rather than voting immediately, the Court tabled the proposal to allow additional discussion and requested that Beacon Data Centers attend a future meeting to answer questions from county officials and the public.
• After Beacon attended the Commissioners meeting that followed the tabling of the moratorium, Commissioner Nanny withdrew the motion in the effort of preserving the ability to bring it forth again in the future after further research and legal discussion. 
• Commissioner Shawn Nanny has continued advocating for increased transparency and represented community concerns before the Texas House Natural Resources Committee.
• Current Status: ONGOING

Lipan-Kickapoo Water Conservation District

• The District reviewed permit requests associated with the proposed project.
• It was discovered the original six test wells were never approved through permitting.
• Requests for additional brackish water test wells were tabled while unresolved questions continue to be reviewed.
• Future meetings are expected as the permitting process continues.
• Current Status: UNDER REVIEW

Texas Commission on Environmental Quality (TCEQ)

• Westline TX Holdings LLC has submitted an air permit application for the proposed data center.
• Permit Numbers:
• Air Permit No. 184380
• PSD Permit No. PSDTX1710
• GHGPSD Permit No. GHGPSDTX275
• The application has been declared administratively complete and is undergoing technical review.
• The public will have opportunities to submit comments and participate as the permitting process moves forward.
• Current Status: TECHNICAL REVIEW

Public Utility Commission of Texas

• A citizen-led petition requesting rulemaking related to hyperscale data center growth has been accepted by the Public Utility Commission of Texas.
• The petition has been assigned Project No. 59824.
• The Commission is expected to open an official public comment period.
• Why It Matters: The petition seeks statewide policy changes related to electric infrastructure, grid reliability, and large industrial loads. 
• Current Status: AWAITING PUBLIC COMMENT

Texas Legislature

• The Committee recently held an interim hearing focused on:
• Data center water use
• Electric grid impacts
• Community transparency
• Local government concerns
• Infrastructure planning
• Several legislators expressed concern that Texas lacks sufficient data on actual water consumption because participation in state surveys has been very low.
• Commissioner Shawn Nanny testified regarding the proposed Beacon project and the challenges counties face when responding to resident concerns.
• Current Status: MONTORING STATEWIDE POLICY

Texas Water Development Board (TWDB) 

• The TWDB reported to lawmakers that only approximately 17% of surveyed data centers responded to statewide industrial water-use surveys.
• Legislators expressed concern that Texas is making long-term planning decisions without complete information regarding industrial water demand.

• The Water Conservation District has considered permit requests associated with the proposed project.
• At the most recent meeting:
• It was discovered the original six test well permits were not approved prior to drilling

• Westline TX Holdings LLC has submitted an application to TCEQ for an air permit associated with the proposed data center project. The application has been declared administratively complete and is currently undergoing technical review. The permit includes emissions associated with emergency diesel generators and other equipment required to operate the facility. Residents will have opportunities to participate in the permitting process through public comments and, if applicable, requests for public meetings or contested case hearings.

Electric Grid

• No public interconnection approval has been announced at this time.
• Texas continues evaluating how large data center projects may impact electric infrastructure, transmission planning, and long-term grid reliability.

• The Public Utility Commission of Texas has accepted a citizen-filed rulemaking petition (Project No. 59824) related to large-scale data center growth and electric infrastructure.
